RENTAL PROPERTY TERMS & CONDITIONS

Hawaii Dream Realty LLC is a licensed real estate firm in Hawaii conducting sales and management on Oahu. All properties are privately and individually owned, and managed by Hawaii Dream Realty LLC on behalf of the individual owner. We are not a “hotel” however we do manage and rent vacation units when the owners are not using them. Units vary by building, amenities, location, size, kitchens, upgrades, improvements, number of guests, and duration of stay.

GUEST REQUIREMENTS: For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder and must register upon check-in. This person is considered to be the Guest; any other persons involved with the rental are considered to be the Guest’s invitees, and all discussion regarding reservation, cancellation, and damages will be discussed with the Guest only, not the Guest’s invitees. All Guests and Guest’s Invitees are required to register with a valid state identification card or passport upon check-in.

DOWN PAYMENT/ PAYMENT: To make a reservation, a down payment of 50% from the total cost of the stay is required at the time the reservation is made, and the full payment must be received no later than 30 days prior to scheduled check-in date (US dollars only). If you prefer to pay the remaining balance due by a check or money order (payable to Hawaii Dream Realty LLC, 2460 Kao Ave, Suite F, Honolulu, HI 96815), make certain payment is received by the due date (30 days prior to check-in date). You may also pay the balance with your credit card as long as the credit/debit card has an expiration date that extends beyond your stay. A credit card convenience fee applies to all credit/debit card payments. If the Guest(s) has no valid Visa or Master Card, a cash or check payment can be arranged which will include an additional $300 refundable damage deposit. This damage deposit will be returned following the departure date, provided there is no breakage or damage to the premises and/or contents, there are no outstanding charges, no additional cleaning costs, and all other rules of this agreement are adhered to. A $50.00 service charge will be incurred for any returned checks.

CANCELLATION: Once a reservation is made (50% payment received), the following cancellation policy shall apply should a reservation need to be canceled for any reason:
DAMAGE POLICY: Every reservation requires $300 refundable damage deposit. The damage deposit may be applied to fees or other charges accrued by the Guest, the Guest Invitees or Guest’s visitors. The entire damage deposit will be refunded if (1) no damage was done to the property other than reasonable wear and tear, (2) all keys are accounted for and returned in good working order, (3) no items were missing, (4) all doors and windows were closed and secured upon departure, (5) all check out procedures were followed, (6) all Rental Agreement policies were followed, (7) no miscellaneous charges were incurred, e.g., unpaid rental fees, late check fees, additional cleaning fees, or other charges. If, during your stay at one of our rental properties, you and/or one of your guests causes any damage to the property or contents within the rental property or to the building or common areas of the building as a result of advertent or inadvertent acts or omissions, the Guest will reimburse Hawaii Dream Realty LLC for the cost to remedy, repair or replace including all labor, materials and applicable taxes. Hawaii Dream Realty LLC reserves the right to charge the Guest’s credit card for any Guest caused losses and damages sustained to the rental property throughout the duration of their period of occupancy. In the event of any Guest loss or damage to the rental property, including, but not limited to, extra cleaning, service calls, service charges, fines/violations or evictions, Hawaii Dream Realty LLC is hereby granted the right to charge the Guest’s credit card. An itemized statement outlining all associated costs will be sent via regular or electronic mail to the address submitted by the Guest at such time as the reservation was booked. The Guest hereby agrees to pay for all such charges, as defined within this agreement without disputing charges at a later date.

BALANCE PAYMENT: Balance is due no later than 30 days prior to your arrival date. If no other payment is received by the 30th calendar day prior to your check-in, we will automatically run the balance on the credit/debit card on file and forward you a receipt. You can call with a different card or notify us your preference to send a check or money order so long as it is received 30 days prior to check-in. Please send your check or money order with your booking confirmation. If the credit card payment fails to process the final balance due and no other form of payment has been received, the reservation will be deemed canceled and subject to applicable cancellation fees.

STARTER SUPPLIES: We try to provide complementary starter supplies including shampoo, conditioner, bath soap, one full roll of each toilet paper and paper towel, dish soap with sponge and trash bag(s). Starter supplies are based on supplier availability and are not guaranteed. These items are supplied in the event you forget your own and or to hold you over until you can purchase your own. Supplies are not stocked with the intent of supplying your needs for the duration of your stay however, when available, you can purchase extra in the office if you’d like to.

BEACH TOWELS: Bed linens and bath towels are provided however Guests are not permitted to use bath towels or bed linens on the beach. Please bring or purchase your own beach towels as not all units provide beach towels. If the unit has beach towels, please do not take/loss the beach towels or you will be charged 2 times the cost to replace the missing/lost/stolen beach towels.

ARRIVAL TIME: Check-in is at 3:00 pm Hawaii Standard Time. Whenever possible, we will try to accommodate checking in earlier than 3:00 pm if the unit is ready and available but we cannot guarantee availability. Please contact us no later than 3 days prior to your arrival to provide your flight information and or to make special arrangements. If you need to check-in BEFORE NOON an early check-in fee equal to one half the nightly rate shall apply as long as the unit is vacant, clean and ready to occupy.

DEPARTURE TIME: Check-out is at 11:00 am Hawaii Standard Time. Your timely departure is appreciated so we can prepare the property for incoming guests. We will try to accommodate requests for a one hour extension to the check-out time if possible; however, an additional fee will be charged (equal to one half of the nightly rate) if you do not return all keys by NOON. If the property has not been vacated by 1:00 pm and a late check out has not been arranged and approved, a fee equal to 2 ½ times the nightly rate may be assessed as a penalty as we might have to cancel or re-book the next guest reservation in situations of abandonment.

CHANGE IN NUMBER OF GUESTS/ CONDUCT OF GUESTS: Guest(s) agrees that more than the number of people stated on the reservation shall not occupy the premises. The rental is provided for accommodations purposes only and shall not be used as a hosting venue. Unauthorized people at the property at any time will result in a double nightly rate charge for each additional guest per day and loss of any damage deposit, in addition to any and all damage, disturbance, and additional cleaning charges. The rental is not intended for parties or gatherings at any time of anyone except those who have paid to occupy the property and have properly registered. If there is excessive noise or music, any illegal activity, or evidence of violation of this policy or the building’s house rules, you may be asked to vacate the premise without any refund and additional charges may be assessed. We reserve the right to contact the police and file a police report if any situation escalates or becomes out of control as deemed by Hawaii Dream Realty LLC. Please inform us of any change in the number of guests before your arrival or upon checking in to avoid these charges. No exceptions or refunds are given for changes in the number of Guests after your arrival. We do not provide “roll away beds” or other types of temporary bedding. Each unit states the maximum number of occupants the unit can reasonably accommodate.

UPON ARRIVAL: Take a look around the property. If there are concerns or issues with your rental property, please immediately contact your host (leave a message if there is no answer and text also) or visit the office. We will do our best to correct any situation or offer other accommodations if available. We are passionate about making our Guests happy but considerations can only be given if proper notice was provided and are mutually agreed. If you check out and do not report any situation, then you will have waived any right to request a consideration after your stay.

CLEANING FEE(s): A non-refundable cleaning fee is required with all reservations. This fee is for our housekeepers who dust, vacuum, sanitize, and clean linens and towels AFTER YOUR STAY. Additional cleaning services are available for a fee upon request. Guest(s) are required to follow all check-out procedures detailed in this agreement and leave the property in the same general and good habitable condition it was in when the Guest(s) arrived. Undue and/or unreasonable cleaning of the property shall be charged to the Guest’s/Cardholder’s credit card as an Additional Cleaning Charge at a rate of $45 per hour with a one hour minimum. This also applies to the property exterior, entrances, lanais (patios), common area and grounds, BBQs, pool and hot tubs (if so equipped). DO NOT BRING SAND INTO THE UNIT - DO NOT WASH EXCESSIVE SAND DOWN TUB OR SINK DRAINS AS YOU WILL BE HELD LIABLE AND RESPONSIBLE FOR THE COST TO EXTRACT SAND FROM THE DRAINS. PLEASE USE BEACHSIDE SHOWERS TO REMOVE SAND FROM YOUSELF AND ALL BEACH ITEMS PRIOR TO RETURNING TO THE PROPERTY. Sand removal will incur additional cleaning fees as well as excessive trash removal in the unit. CLEANING REQUIREMENTS: During your stay, please take care to keep the unit tidy by removing trash daily so that any garbage does not attract bugs; be sure to tie trash bags before placing down the proper refuse (trash shoots located on each floor). Under NO circumstances should garbage be placed outside or left in the hallway or a fine / violation may apply. Please do not leave any opened food items out such as breads, pastries or chips; we recommend storing all food in the refrigerator or in a sealed container or baggie. Please wash any dishes used daily to prevent attracting BUGS; do not leave dirty dishes in the sink or out on the counters or in the cupboards. Also please make sure that water does not splash outside of the tub or shower liner; failure to do so may result in damages to the unit and or the surrounding units that you could be held liable. Upon you departure, place dirty towels in the bathtub not on the floor, wash dirty dishes, cookware and eating utensils (if your rental comes with a dishwasher, place all dirty dishes in the dishwasher and run the cycle upon departure), floors should be in good condition and ready to be vacuumed by our housekeepers, household trash, garbage, recycling and/or other discarded items should be properly bagged so as to avoid spillage or leakage. Refrigerator and microwave should be left clean and free of food. All appliances (cooktop, stove, oven, BBQ, etc.) should be left in a clean condition and free of food particles, spills and grease. Please wipe down counters and other surfaces.

LINENS & TOWELS: Sheets, pillows and blankets are provided unless otherwise noted on property amenities page. We do not provide any linens or towels for outdoor use. DO NOT take the property’s linens or towels outside. Bring items with you that you may need for any outside use. You are welcome to wash the property’s linens during your stay. DO NOT hang anything on the lanai (patio) railings as a fine or violation will be issued by the building’s management (towels, signs, etc.).

SMOKING: Smoking is NOT permitted in any rental properties. Smoking is allowed outside however common areas and within 20 feet of a building’s entrance, openings or windows is prohibited under Hawaii State law. Discard any butts and ashes in the outside garbage only and do not put any down the trash chute. Do not throw butts on the ground or bring them into the property. If there is any smoke smells in the property after your departure, there will be a minimum charge of $250 to have the unit deodorized. Oil lamps, vaporizers, and incense are not permitted due to the long-lasting odor. If these policies are violated, there will be a charge for excessive cleaning and or possible damages.

PLUMBING: Do not put any feminine products in the toilet; please dispose feminine products in the trash. The toilets and pipes may clog if excessive toilet paper is put down the toilet at one time – limiting the amount of toilet paper used prior to flushing will help prevent a clog. Plungers are provided if a clog occurs. Do not pour grease down the drain. If a plumber has to be called and the clog is due to your misuse, you will be held responsible for the plumbing repair. Please report any leaks or puddles of water found immediately so that the source can be found and remedied before it causes major damage.

TELEVISION, INTERNET & PHONES: All properties are privately owned and have different subscription packages for cable and/or satellite and Internet. Hawaii Dream Realty LLC does not guarantee any programs, events or reception. Guest(s) are liable if they order any Pay-per-View – if Guest(s) does not use their own credit card for ordering additional services, programming charges plus an additional $10 processing fee will be charged. Not all properties are equipped with a telephone; those properties that do provide a phone, only local phone calls are free of charge. UTILITIES: All units have electric, water and sewer services and there are no additional charges due to excess usage. We requests Guest(s) cooperate with efforts to conserve energy / utilities by turning off lights and the air conditioner when not in the unit as to reduce unnecessary waste. Should any problems occur such as temporary outages, please report them to your host as soon as possible.

PETS: Most properties do not allow pets however some will allow pets as long as the applicable pet fees have been paid. Unauthorized occupancy of pets will result in immediate eviction and loss of all rents and deposits. Service animals are excluded by law however be aware of Hawaii’s strict quarantine rules regarding pets coming to Hawaii.

PERSONAL ITEMS: Please check carefully for belongings before you leave. Should you forget personal items, they will be placed in lost in found. If you claim any items from lost and found, and provide payment for shipping plus a $20 handling fee per package, we can arranged for your items to be mailed back to you. Hawaii Dream Realty LLC is not responsible for abandoned, lost or stolen items.

MAILING PARCELS: Please do not mail packages to the unit’s address as we do not have mailbox keys for the units. Please do not mail packages to the office address as we do not have a mailbox. If parcels are received, they will be subjected to a handling /storage fee of $25 per package / parcel. Hawaii Dream Realty LLC reserves the right to reject any mail, package or parcel for any reason and will not forward mail, packages or parcels internationally.

LOST KEY REPLACEMENT: If you do not return all keys in good working order or if you lose your keys, you will be subject to replacement cost of all keys, FOB and Security Key.

PARKING / PARKING PASS: Not all properties provide parking with the rental unit however, should the unit provide parking, be certain to use the parking pass provided and RETURN THE PASS PRIOR TO DEPARTING or replacement cost shall be charged to your credit card.

AVAILABILITY: Hawaii Dream Realty LLC reserves the right in case of non-availability of the vacation unit due to any particular reason, to substitute a property of similar standard and sleeping capacity.

EMERGENCIES/ MAINTENANCE: In the event of a problem getting in the property or if there are problems with condition or functionality of the property, please immediately contact your host (leave a voice message and send a text message if there is no answer). If the emergency occurs during office hours, come to the office (ground floor of Kuhio Village Tower One between front lobby doors and parking garage ramp) to report the issue or concern as soon as possible.

RIGHT OF ENTRY: Guest(s) agree that Hawaii Dream Realty LLC reserves the right to enter the rental property any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate, or to show the property to prospective purchasers or Guests (in which case prior notification will be given). SECURITY & SAFETY RISKS: ALWAYS LOCK DOORS AND WINDOWS WHEN YOU LEAVE THE RENTAL PROPERTY! When you rent the property, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave the property. Children are welcome, but there are conditions in and around the property that may pose hazardous to them, as well as to adults, such as the ocean, canal, open stairways, busy roads, etc. Hawaii Dream Realty LLC does not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. Candles are not allowed due to fire hazard.

INDEMNIFICATION & HOLD HARMLESS: While Hawaii Dream Realty LLC and its property owners strive to maintain rental properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All Guest(s) and their invitees use the rental property structures and premises at their own risk. Hawaii Dream Realty LLC and its property owners shall not be held liable or otherwise responsible in any way for injury to any Guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said Guest(s) and/or invitees, or by the failure of structures, appliances (including pools, hot tubs and BBQs), furnishings, and/or other equipment, whether by malfunction, misuse, acts of nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the rental properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the rental property and/or its contents. Hawaii Dream Realty LLC and its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to Guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the rental property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this Agreement, Guest(s), invitees or Guest’s visitors hereby agree to forever hold-harmless and indemnify Hawaii Dream Realty LLC and its property owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the Guest(s) use of the property.
